Reasons/basis
To grant Mr Gordon Geoffrey Young a practising certificate for the practice year 2010/2011 subject to the following condition:
That if he becomes a recognised sole practitioner or a manager of a recognised body, that he lodges half yearly accountant’s reports, such reports to be delivered within 2 months of the end of the period to which they relate; and any Cease to Hold accountants reports required under the Solicitors’ Accounts Rules are to be delivered within 2 months of the end of the period to which it relates.
Other information
Mr Young continues to be subject to Regulation 3.1[c]; [d](i); [g]; [k](i) and [n] of the SRA Practising Regulations 2009.
Accordingly, the SRA is required to consider whether it is proportionate, reasonable and necessary in the interests of the public to impose any conditions on Mr Young’s practising certificate for 2010/2011 for one or more of the purposes set out in Regulation 6.1 of the SRA Practising Regulations 2009.
The Authorised Officer noted that Mr Young, in his Reg 3 practising certificate application for 2010/2011, has provided evidence of his compliance with the condition attached to his 2009/2010 practising certificate, that within six months of the date of notification of the decision, he attends a course, accredited by the Solicitors Regulation Authority, for the purpose of continuing professional development on the Solicitors’ Code of Conduct 2007 and provides confirmation of his attendance (in the form of a certificate or letter of attendance from the course provider) when he next applies for a practising certificate.
Mr Young has provided evidence in the form of a Certificate of Attendance on the course in question, in compliance with the condition attached to his 2009/2010 practising certificate.
However, The Authorised Officer noted that a second condition was imposed on Mr Young’s 2009/2010 practising certificate: that that if he becomes a recognised sole practitioner or a manager of a recognised body, that he lodges half yearly accountant’s reports, such reports to be delivered within 2 months of the end of the period to which they relate; and any Cease to Hold accountants reports required under the Solicitors’ Accounts Rules are to be delivered within 2 months of the end of the period to which it relates.
In his practising certificate application for 2010/2011, Mr Young has indicated that he is content for the condition that should he become a recognised sole practitioner or manager of a recognised body, that he deliver half yearly accountant’s reports, to continue for the 2010/2011 practice year.
The authorised Officer was satisfied that it remains proportionate, reasonable and necessary in the interests of the public for the purposes of Regulation 6.1(e) of the SRA Practising Regulations 2009 that the condition that should he become a recognised sole practitioner or manager of a recognised body, that he deliver half yearly accountant’s reports, should continue to apply to Mr Young’s practising certificate for the practice year 2010/2011.
