Outcome of SDT Hearing

This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which reaches its own decision after considering all the evidence, including any evidence put forward by the Respondent. The Tribunal had certified that there was a case to answer.

The matter was heard on 16 November 2016.

Ms Bradley was suspended from practice as a solicitor for a period of five years.

Upon the expiry of that fixed term of suspension Ms. Bradley must produce to the SRA documentary evidence of attendance at and satisfactory completion of a minimum of two Law Society courses on the Solicitors Accounts Rules which are in force at the proposed date of return to practice. Further, on the expiry of the fixed term of suspension Ms. Bradley shall be subject to conditions imposed by the Tribunal as follows:

Ms. Bradley may not:

  1. Practise as a sole practitioner or sole manager or sole owner of an authorised or recognised body
  2. Be a partner or member of an LLP, LDP or ABS or other authorised or recognised body
  3. Be a COLP or COFA
  4. Hold client money
  5. Be a signatory on any client account
  6. Work as a solicitor other than in employment approved by the SRA Ms. Bradley shall immediately inform any actual or prospective employer of these conditions and the reasons for them

Decision to intervene into practice

Reasons/basis

The Committee is satisfied in accordance with paragraph 1(1)(a) of Schedule 1, Part I of the Solicitors Act 1974 (as amended) that there is reason to suspect dishonesty on the part of Ms Bradley.

The Committee was further satisfied that grounds for intervention existed under Paragraph 1(1)(c) of Part 1 of Schedule 1 of the Solicitors Act 1974 (as amended) Ms Bradley has failed to comply with the rules made by virtue of section 31 or 32 of that Act, namely the SRA Principles 2011, the Solicitors Accounts Rules 1998 and the SRA Accounts Rules 2011.
