Ackroyd Legal (London) LLP (at the time called Stirling Ackroyd Legal LLP) failed to perform its undertaking which included taking the necessary steps to ensure a lender’s charge had priority and registering the charge within the priority period. The firm’s failure to maintain priority and delay in registering the charge meant that the lender’s charge lost priority and ranked below a bankruptcy notice charge.

Its conduct in this regard failed to achieve outcome 11.2 of the SRA Code of Conduct 2011 and breached SRA Principle 6 of the SRA Principles 2011.

Outcome 11.2 required the firm to perform all undertakings given by it within an agreed timescale or within a reasonable amount of time.

Principle 6 required it to behave in a way that maintained the public’s trust and confidence in it and the profession.
