A finding of dishonesty was made against Mr Kitumaini and he was made subject to a disqualification order under section 99 of the Legal Services Act 2007. The SRA has disqualified Mr Kitumaini from holding any of the following roles in law firms regulated by the SRA:
- An employee
- A manager
- A head of legal practice
- A head of finance and administration
Reasons/basis
It was found, on his own admission, that Mr Kitumaini misled his employers by providing them with a candidate profile/CV stating that he had achieved an LLM qualification with a merit when he had not and misled Bexley Beaumont Limited when it challenged him about the veracity of information provided in his CV
Other information
Mr Kitumaini's conduct breached duties that applied to him as an employee, namely, to act honestly (in breach of Principle 4), and he failed to uphold trust and confidence in the profession and in the provision of legal services (in breach of Principle 2) It was found that it would be undesirable for Mr Kitumaini to act as an employee, a manager, a head of legal practice and head of finance and administration of a body licensed in accordance with section 99 of the Legal Services Act 2007. Already said this above. He was also directed to pay costs of £1,350
